Unfortunately not all blood is created equal. Since 1983, the FDA has ban blood donations from men who have sex with men (MSM). Originally established during the HIVand AIDS epidemic as an emergency measure to prevent contamination of the U.S. blood supply, the restriction prevents any man who had sex with another man, regardless of sexual orientation, from donating blood.

In 2015, the FDA revised its MSM deferral ban.  Today, MSM can donate blood on the condition that they have not engaged in any sexual activity with another man in the one-year preceding the donation.

Current policy is not supported by science. and impacts MSM, women who have sex with MSM, and transgender people who could be considered MSM.

It’s time for a different approach, not stigma! If you support the need for change we invite you to sign the current online petition. Help bring Equality to blood donation.

Eligibility guidelines currently instituted, specifically the Food and Drug Administration’s ban on “males who have had sexual contact with another male in the last 12 months,” are outdated and do not in any way express the views of the County of Santa Clara. Please be aware that the County of Santa Clara Board of Supervisors voted unanimously in opposition of this ban and are encouraging their Federal Lobbyist to work to overturn the ban.
